Complaint procedure

  1. Step 1: Receipt

    A complaint is filed with the Austrian Ombudsman Board.

  2. Step 2: Responsibility

    The Austrian Ombudsman Board checks whether it is legally responsible. If so, the confidential investigative proceedings begin.

  3. Step 3: Investigation

    The Austrian Ombudsman Board studies all documents and files submitted.

  4. Step 4: Authority

    The Ombudsman Board confronts the authority concerned and asks it to comment on the complaint within a certain period of time. The Ombudsman Board must be supported in its work by the authorities.

  5. Step 5: Assessment

    On the basis of the law, case law and the principles of good administration, the Ombudsman Board reviews the decision of the authority and examines whether there has been a case of maladministration.

  6. Step 6: Result

    The Ombudsman Board then informs those affected and the authority of the results of the review. On average, it takes around two months to receive feedback. If the proceedings take longer, the Ombudsman Board informs about the interim status of the case.

  7. Step 7: Recommendation

    If the Ombudsman Board identifies an irregularity, it recommends that the authority remedies the maladministration.
