Where can I apply for a pension for victims of children’s homes?

Here you can find the application form and the informtaion sheet on the pension for victims of children’s homes.

You can submit an application to these offices:

  • Pension Insurance Institution (PVA)
  • Social Insurance Institution for the Self-Employed (SVS)
  • Insurance Institution for Public Employees, Railways and Mining (BVAEB)
  • Social Ministry Service (SMS)
  • any other social insurance institution (e.g. regional health insurance fund)
  • Pension Commission of the Ombudsman Board
  • Court or municipal office

Is the Austrian Ombudsman Board responsible for me?

The Ombudsman Board deals with applications from persons who have not yet received compensation from a victim protection organisation or whose application has been rejected.

The pension-paying body or the Social Ministry Service informs the Ombudsman Board about these applications. The Ombudsman Board (Office of the Pension Commission) then contacts the applicants.

    The pension-paying body or the Social Ministry Service informs the Ombudsman Board about the applications.

  2. Step 2: Contact

    The Austrian Ombudsman Board contacts those affected.

  3. Step 3: Information from the authorities

    The Ombudsman Board obtains the file from the youth welfare authority or the hospital documents.

  4. Step 4: Clearing conversation

    The applicant is invited to an interview with a clearing expert. These experts prepare a report (approx. four pages) together with the applicant.

  5. Step 5: Decision of the Pension Commission

    The clearing report is anonymised and submitted to the Pension Commission.

Who decides on my application?

The Ombudsman Board submits a reasoned written recommendation to the pension-paying body or the Social Ministry Service. The Pension Commission's proposal is the basis for this recommendation.

The pension-paying body or the Ministry of Social Affairs finally decides on your application with a written decision. The decision will be sent to you by the pension-paying body or the Social Ministry Service.

I do not agree with the decision of the pension-paying body or the Social Ministry Service!

Then you can file a complaint against the decision to the Labour and Social Court (ASG) within four weeks of receiving the decision.
