He turned to the Austrian Ombudsman Board, in the portfolio of Ombudsperson Christoph Luisser, because his driving licence had been temporarily withdrawn during a traffic check. The official medical blood test showed that there was no medical or legal reason for the withdrawal of his driving licence. Mr R. subsequently received his probationary driving licence back without an extension to the probationary period or any other restrictions. However, when he wanted to apply for the entry of code 111 (permission to drive motorbikes of category A1/125 cc with a B driving licence without having to take an additional test) in his driving licence in April 2025, he was refused this with reference to the (still) existing driving licence withdrawal entry. As the entry of the driving licence withdrawal had been made without a legally valid decision and had been stored inadmissibly, he suspected maladministration.
The district governor of Vöcklabruck District Court answered the Ombudsperson's enquiry. Mr R. had initially been issued with a decision which would have meant the withdrawal of his driving licence for one month, an official medical examination, a traffic psychological and specialist psychiatric opinion as well as additional training. Mr R. had taken legal action and the blood report had not revealed any impairment relevant to road traffic. The subsequent reissue of the driving licence at the end of September 2020 would not have been properly recorded in the driving licence register.
"The Austrian Ombudsman Board objected to the fact that the Vöcklabruck BH apparently did not initially make the expiry of the revocation notice visible in the driving licence register. The correction in the driving licence register was made in April 2025, so that it is finally possible to enter code 111 in Mr R.'s driving licence," reports Ombudsperson Christoph Luisser.
Conclusion: The completed driving licence withdrawal should have been deleted from the driving licence register.
