Brinek: Property entrance blocked by playground

A landlady from Graz turned desperately to the Ombudswoman: Soon she will be unable to drive into the garage with her car because a playground shall be constructed just outside the entrance gate.

According to the Styrian Federal Building law, a playground has to be constructed when buildings with more than three residential units are built. In the course of a plan change, the building authority approved such a playground, although the property is burdened with a servitude. The parties concerned immediately turned to the building authority and pointed out their registered right of way. An employee of the building authority assured himself about the local conditions. But instead of integrating the neighbors in the proceedings and pointing out the problem with the servitude to the real estate developers, the senate of the city of Graz granted the requested permit.

For Ombudswoman Brinek it is questionable whether this property is suitable as a children's playground, when cars drive over this land. Ombudswoman Brinek: "The approval is incomprehensible, as the building code provides a convenient and secure property. These conditions are here obviously not given. I ask the authority and the real estate developers to work out a suitable solution for the neighbors and for the children playing.”
